Terms of Service

These Terms of Service (“Terms”) govern your use of the FitScroll mobile application (the “App”) operated by AppLab Kamil Piekarz (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

FitScroll is a digital wellbeing and fitness application that helps users manage their screen time by rewarding physical activity with access to selected mobile applications. The App allows users to block social media and other distracting apps, earn virtual coins through exercises (tracked via camera-based pose detection), step counting (via Apple Health), running, and cycling, and spend those coins to temporarily unlock blocked apps.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

3. Account Registration

• You may create an account using Apple Sign-In, Google Sign-In, or email and password.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• Account creation is optional — you may use the App without an account, but data sync across devices requires signing in.

4. Subscriptions & Payments

• The App offers subscription plans (weekly, monthly, annual) that unlock premium features.
• Subscriptions are billed through Apple's App Store and managed by RevenueCat.
• Free trials may be offered. You will not be charged during the trial period. If you do not cancel before the trial ends, the subscription will automatically renew at the stated price.
• You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled according to Apple's refund policies.
• We reserve the right to change subscription pricing. Existing subscribers will be notified before any price changes take effect.

5. Virtual Coins

• Coins are virtual items earned through physical activity within the App.
• Coins have no monetary value and cannot be exchanged, transferred, sold, or redeemed for real currency.
• Coins are used solely to unlock temporarily blocked applications within the App.
• We reserve the right to modify coin earning rates, spending values, and the coin economy at any time.

6. App Blocking & Screen Time

• The App uses Apple's Screen Time framework to restrict access to selected applications on your device.
• You grant the App permission to manage app restrictions when you enable Screen Time access.
• App blocking is voluntary — you choose which apps to block and can modify your selection at any time.
• We are not responsible for any inability to access blocked apps in emergency or time-sensitive situations. You can always disable restrictions through your device's Screen Time settings.

7. Exercise Tracking & Health Data

• Camera-based exercise tracking uses on-device machine learning and does not store, record, or transmit video or images.
• Exercise rep counting is performed by AI and may not be perfectly accurate. We are not liable for inaccurate counts.
• Health data accessed from Apple Health is used solely for the App's functionality and is handled in accordance with our Privacy Policy.
• The App is not a medical device and should not be used as a substitute for professional medical advice or fitness guidance.

8. Health Disclaimer

The App encourages physical activity but is not a substitute for professional medical or fitness advice. You should consult a healthcare provider before beginning any exercise program. You use the exercise features at your own risk. We are not responsible for any injury, health issue, or adverse effect resulting from exercises performed while using the App.

9. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, achievement designs, and software — are owned by AppLab Kamil Piekarz and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

10. Acceptable Use

You agree not to:

• Attempt to manipulate, exploit, or circumvent the coin economy or exercise tracking system
• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Interfere with or disrupt the App's infrastructure
• Share your account with others or create multiple accounts to abuse the system

11. Termination

• You may stop using the App and delete your account at any time from within the App (Settings > Delete Account).
• We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.
• Upon termination, your right to use the App ceases immediately. Cloud-synced data will be deleted.

12. Limitation of Liability

To the fullest extent permitted by law, AppLab Kamil Piekarz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the App. Our total liability shall not exceed the amount you paid for the App's subscription in the 12 months preceding the claim.

13. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

14. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
